Introduction
Trinity Industries, Inc. and its affiliates and subsidiaries ("Trinity," "we," “our,” or “us”) values your privacy. This California Privacy Policy (“Policy”) provides additional information for California residents and describes our information practices pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 and its implementing regulations (the “CCPA”). Depending on how you interact or engage with us, we may provide you with other privacy notices with additional details about our privacy practices. For additional information on our general privacy practices, please visit our Privacy Policy. Capitalized terms have the same definition as in our Privacy Policy unless otherwise noted.
To the extent you are a California resident, and we collect “Personal Information” as defined by the CCPA, this Policy applies. This Policy does not address or apply to our handling of Personal Information that is exempt from the CCPA, such as publicly available information or deidentified or aggregated information.
Trinity is primarily a business-to-business entity providing industrial products and services to its business customers in the industrial, energy, transportation, and construction sectors. Our website is intended for our business customers.
Categories of Personal Information We Collect Directly from You
The following identifies the categories of Personal Information we may collect about you (and may have collected in the prior 12 months):
- Identifiers. Such as name, alias, email, phone number, address, unique personal identifier, online identifier, IP address, account name, or other similar identifiers.
- Customer Records. Includes your account and profile information and customer records that contain Personal Information, such as name, account name, other characteristics or descriptions, email, address, phone number, and other contact information, account credentials, communications preferences, billing and payment information, customer service and support tickets and records, and other information you provide.
- Commercial Information. Such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
- Protected Classifications. To the extent voluntarily provided by you or to comply with applicable law, we may collect certain characteristics of protected classifications, such as sex, gender identity, age, and marital status.
- Audio, Electronic, Visual, or Similar Information. Includes information collected via call recordings if you are interacting with us in a customer service capacity or if you call us on a recorded line, recorded meetings and webinars, videos, photographs, and CCTV footage to secure our offices and premises.
- Inferences. Such as inferences drawn from any of the information described in this section about a consumer including inferences reflecting the consumer’s preferences, characteristics, behaviors, attitudes, abilities, and aptitudes.
Personal Information We Collect Automatically
We and our service providers may automatically collect Personal Information related to your use of the Services through cookies, pixel tags, and other similar technologies. The Personal Information we may automatically collect when you visit our Sites or interact with our Services may include:
- Internet or Other Electronic Network Activity Information. Includes, but is not limited to, browsing history, clickstream data, search history, information regarding interactions with our website, advertisements, or emails, and usage data such as page views, links and items clicked, features used, scrolling activity, time spent within the Services, and other activity and usage related.
- Geolocation Data. We may collect device location information about you, such as through your IP address. We may also collect device location information about you through our fleet management software.
Personal Information We Collect from Other Sources
In addition, we may collect and receive Personal Information about you from affiliates and subsidiaries, business partners, clients and customers, data analytics providers, social networks, internet service providers, operating systems and platforms, government entities, public databases, information brokers, and vendors and service providers who provide services or perform functions on our behalf. For example, we may collect certain contact information, such as your name and email, from our business partners, and vendors and service providers. We also may receive certain Personal Information from our business customers and clients for purposes of administering our Services, or data analytics.
Purposes for Collecting and Disclosing Personal Information
In general, we collect and otherwise process the Personal Information we collect for the following business or commercial purposes:

When deciding how long to keep your Personal Information, we consider whether we are subject to any legal obligations (e.g., any laws that require us to keep records for a certain period of time before we can delete them) or whether we have taken any legal positions (e.g., issued any legal holds or otherwise need to preserve the information). The CCPA provides California residents with certain rights regarding their Personal Information. In general, California residents, including our business contacts who reside in California, have the following rights with respect to their Personal Information, subject to certain exceptions:
Right to Know/Access. With respect to the Personal Information we have collected about you, you have the right to request:
- The categories of Personal Information we collected about you;
- The categories of sources from which the Personal Information is collected;
- Our business or commercial purposes for collecting and disclosing Personal Information;
- The categories of third parties to whom we have disclosed your Personal Information; and
- A copy of the specific pieces of Personal Information we collected about you.
Right to Correct. You have the right to request that we correct inaccuracies in your Personal Information.
Right to Delete. You may have the right to request that we delete the Personal Information we have collected from you.
Right to Opt-Out of Sales and Sharing.
We do not “sell” or “share” Personal Information as defined under the CCPA.
Right to Limit Use and Disclosure. We do not use or disclose “sensitive personal information” for purposes that would require us to comply with a "right to limit" request under CCPA.
Right to Non-Discrimination. We will not discriminate against you for exercising any of the rights described in this section.

For all requests submitted via mail, please clearly state that the request is related to your “California Privacy Rights” and provide your name, mailing address, and phone number where you may be reached.
Verification. Before we can respond to your request, we must first verify your identity using the Personal Information you recently provided us. We will take steps to verify your request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information in order to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for the denial.
Authorized Agent. You may designate someone to submit requests and act on your behalf. Authorized agents will be required to provide proof of their authorization in their first communication with us, and we may also require that the relevant consumer directly verifies their identity and the authority of the authorized agent.
Changes to this Policy
The Policy is current as of the date set forth above. We may change, update, or modify this Policy from time to time, so please be sure to check back periodically. We will post any updates to this Policy here. If we make any changes that materially affect our practices regarding our use of the Personal Information, we have previously collected from you, we will endeavor to provide you with notice, such as by posting prominent notice on our website.
